Terms of Service

Effective: October 2, 2026

What changed on October 2, 2026: We updated the introduction and Sections 2, 4, 7, and 9 to describe how our genetic test works, including that genetic test purchases are final, and added a genetic test refund section. We also made small wording updates to Sections 10 and 11.

These Terms of Service (“Terms”) are a legal agreement between you and The Vitality Collective LLC (“The Vitality Collective,” “we,” “us,” or “our”), a Connecticut limited liability company based in Milford, Connecticut. We are an online wellness and telehealth company that helps adults access hormone replacement therapy (HRT), peptide therapy, and custom lab and blood panels through a network of independently licensed clinicians, and genetic testing through an independent testing company.

These Terms apply to thevitalitycollective.co and any of its subdomains, including our booking site at book.thevitalitycollective.co (together, the “Site”), and to the content, digital products, forms, discovery calls, communications, community features, and other services we offer through the Site (together with the Site, the “Services”).

Please read these Terms carefully. They include important information about your legal rights, including the disclaimer of warranties in Section 19, the limitation of liability in Section 20, and how disputes are handled in Section 22.

Contents

1. Accepting These Terms

By accessing or using the Services, creating an account, submitting a form, booking a call, or making a purchase, you agree to these Terms. If you do not agree, please do not use the Services.

Our Privacy Policy and Consumer Health Data Privacy Policy explain how we collect, use, and share personal information, including health-related information. Please read them as well.

Some Services come with additional terms, such as the terms shown at checkout, the Telehealth Informed Consent and other clinical documents described in Section 6, the terms of the patient ordering storefront described in Section 7, community terms or guidelines, and affiliate program terms. Those additional terms also apply when you use those Services. If additional terms conflict with these Terms, the additional terms control for that specific Service.

2. Who Can Use the Services

To use the Services, you must:

  • Be at least 18 years old and able to enter into a binding contract;
  • Be a resident of the United States and located in the United States when you use the Services; and
  • Not have been previously suspended or removed from the Services.

Available nationwide. Some visit requirements vary by state. Some services, products, medications, and lab or genetic tests are not available in every state, and availability may change over time. To receive clinical services, you must be physically located, at the time of your visit, in a state where a clinician in our clinical network is licensed and where the service is offered. Genetic testing is provided by an independent testing company, not by our clinical network, as described in Section 7. We may ask you to confirm your age, identity, and location.

You may use the Services only for yourself. You may not create an account for, order on behalf of, or provide information about another person as if it were your own.

3. Educational Content Is Not Medical Advice

Our Site, emails, social media posts, digital products, self-check questionnaire, discovery calls, and community share general educational information about topics such as hormone health, peptide therapy, genetic and lab testing, nutrition, and overall wellness. This content is designed to help you understand your options and have informed conversations with a licensed clinician.

Our educational content is not medical advice, diagnosis, or treatment, and it is not a substitute for care from a licensed clinician who knows your health history. Do not start, stop, or change any medication, supplement, or treatment, and do not delay seeking care, because of something you read, watch, or hear through the Services.

  • Self-check. Our free self-check is an educational questionnaire. Your results are general information only. They are not a diagnosis or a clinical evaluation, and they do not mean you will qualify for any treatment.
  • Discovery calls. Discovery calls are informational conversations with our team. They are not medical appointments, and our team members do not provide medical advice during them.
  • No provider-patient relationship. Using the Services, including reading our content, buying a digital product, completing the self-check, booking a discovery call, or joining our community, does not create a provider-patient relationship with us or with any clinician. A provider-patient relationship begins only when an independent licensed clinician reviews your medical intake and accepts you as a patient.

The Vitality Collective does not practice medicine. We work to keep our content accurate and up to date, but health information changes as research develops, and general content cannot account for your individual circumstances.

4. Clinical Services and Independent Clinicians

Medical evaluations, prescriptions, lab test orders, and other clinical care offered through the Services are provided by independent licensed clinicians in our clinical network, not by The Vitality Collective. Genetic testing works differently, as described in Section 7. Clinicians are not employees or agents of The Vitality Collective.

  • Independent judgment. Clinicians use their own independent professional judgment. We do not control or interfere with their clinical decisions.
  • Medical care. Medical care through The Vitality Collective is provided by independent licensed clinicians. For anything medical, talk with a licensed clinician. A clinician may recommend, adjust, decline, pause, or stop any treatment, test, or prescription, and may ask for more information, lab work, or a live consultation before making a decision.
  • No guaranteed prescription or outcome. Completing an intake, booking a consultation, or purchasing a program or service does not guarantee that you will receive a prescription, a particular medication or dose, or any particular result.
  • Responsibility for care. Each clinician is responsible for the care they provide. Nothing in these Terms limits any rights you have with respect to the care you receive from a clinician.

Some treatments a clinician may prescribe are compounded medications, which state-licensed pharmacies prepare for individual patients. Compounded medications are not FDA-approved, which means the FDA has not reviewed them for safety, effectiveness, or quality. Your clinician can talk with you about the potential benefits, risks, and alternatives of any treatment.

Please follow your clinician’s instructions, tell your clinician about any changes in your health or medications, and report any side effects promptly. We encourage you to keep a primary care provider and to share relevant information with them.

5. Emergencies

The Services are not for emergencies or urgent medical needs. If you think you may be having a medical emergency, call 911 or go to the nearest emergency room right away. If you are in crisis or thinking about harming yourself, call or text 988 to reach the 988 Suicide & Crisis Lifeline.

Do not use email, website forms, text messages, social media, or the community to communicate urgent health concerns. These channels are not monitored around the clock.

Before you receive clinical care, you will be asked to review and accept a separate Telehealth Informed Consent and other clinical documents, and you will receive the applicable Notice of Privacy Practices (“NPP”). These documents explain the benefits, risks, and limitations of telehealth and how your protected health information is used and protected. They are separate from these Terms, and they control on clinical matters.

If you do not accept the clinical documents, you will not be able to receive clinical services, but you may still use the educational parts of the Services. You can request a copy of the NPP at any time by emailing welcome@thevitalitycollective.co.

7. Prescriptions, Pharmacy Orders, Labs, and Genetic Testing

Patient storefront and pharmacies

Orders for prescribed medications and certain other patient products are placed through a storefront that carries our branding but is operated by a third-party telehealth and pharmacy-fulfillment platform. Prescriptions are filled and shipped by licensed pharmacies. The platform and the pharmacies have their own terms, privacy notices, and policies, including for billing, shipping, subscriptions, and refills, and those apply to your patient orders. Please review them before you order.

  • Medications are dispensed only with a valid prescription and are for your personal use only. Do not share, sell, or give them to anyone else.
  • Some medications can’t be shipped to every state. The pharmacy may need to verify your identity, address, or prescription before shipping.
  • Follow all storage and use instructions that come with your medication, and contact your clinician with any questions or concerns.

Lab testing

Lab tests are performed by independent, licensed laboratories. Some tests require a clinician’s order or a blood draw at a patient service center. Some lab and genetic tests aren’t available in every state. Your clinician reviews ordered results as part of your care. Lab results generated as part of your care are handled under the NPP.

Genetic testing

Our genetic test is provided by Genomic Dietetics & Performance Corp, an independent company, which arranges laboratory testing of your sample and prepares your written report. You buy the test through our checkout and under these Terms. After you purchase, The Vitality Collective submits the kit request for you, but it doesn’t authorize the test or review your results clinically. Each test is authorized by an independent clinician working with Genomic Dietetics & Performance Corp or its laboratory.

Genetic testing can provide useful insight into how your body works, but every test has limits, and results cannot predict your health with certainty. Results don’t diagnose a condition, may need confirmation with clinical testing ordered through a healthcare provider, and may reveal information you did not expect, including information that may be relevant to your biological relatives. Your report may include supplement, peptide, nutrition or lifestyle suggestions from the testing company. The Vitality Collective doesn’t review or endorse them. Talk with a licensed clinician before acting on them or making health decisions based on your results.

Our walkthrough explains what the report covers. It’s education, not medical advice or genetic counseling. If a result raises a medical question, talk with a genetic counselor or a licensed clinician.

Before you buy, you give the two separate genetic test consents described in Genetic Testing and Genetic Data in our Privacy Policy. Genomic Dietetics & Performance Corp and its laboratory handle your sample and genetic data under their own policies. We don’t keep your report or your raw DNA data.

Genetic test refunds

All genetic test purchases are final, and there are no refunds once you’ve paid. The only exception: if we can’t order or ship your kit, you’ll get a full refund. If your kit arrives damaged or the lab can’t process your sample, contact welcome@thevitalitycollective.co and we’ll work with the testing company on a replacement.

8. Accounts and Accurate Information

Some Services require an account, which may be on our Site, our booking site, the patient storefront, or our community platform. When you create or use an account, you agree to:

  • Provide information that is accurate, current, and complete, and keep it up to date;
  • Give clinicians complete and truthful health information, including your medical history, current medications, supplements, and allergies. Inaccurate or incomplete information can lead to care that is not appropriate for you and may put your health at risk;
  • Keep your login credentials secure and not share them with anyone;
  • Be responsible for activity that happens under your account; and
  • Tell us promptly at welcome@thevitalitycollective.co if you believe someone has accessed your account without permission.

Each account is for one person. We, our clinicians, and our pharmacy partners may verify your identity, age, and location before providing certain Services.

9. Purchases, Pricing, Payment, and Taxes

  • Pricing and payment terms. The price, fees, and payment terms for each product or service are shown at checkout and may also appear on the product page. All prices are in U.S. dollars.
  • Taxes. You are responsible for any applicable sales, use, or similar taxes. Where we are required to collect taxes, they will be shown at checkout.
  • Payment. By placing an order, you authorize us, or the platform processing your order, to charge your payment method for the total shown at checkout, including taxes and fees, and for any recurring charges you agree to. Payments are processed by third-party payment processors such as Stripe. We do not receive or store full card numbers. Please keep your payment information current.
  • Price changes. We may change prices at any time. Price changes do not affect orders you have already placed. Price changes for subscriptions are handled as described in Section 10.
  • Errors. We work to describe and price our products accurately. If we discover an obvious error in a price or description, we may correct it and may decline or cancel an affected order. If we do, we will let you know.
  • Promotions. Discount codes and promotional offers are subject to the terms stated with the offer. Unless the offer says otherwise, they have no cash value, cannot be combined, and may expire.
  • Patient orders. Orders placed through the patient storefront are processed under that platform’s checkout terms.
  • Genetic tests. Genetic test purchases are final, except as described in Section 7.

10. Subscriptions, Memberships, and Automatic Renewal

Some offerings, such as paid community memberships, programs, or medication plans available through the patient storefront, may be sold as subscriptions that renew automatically until you cancel.

  • Clear terms at checkout. Before you subscribe, the checkout page will clearly show the price, how often you will be charged, that the subscription renews automatically until you cancel, any introductory or trial terms and the price that applies afterward, and how to cancel. We will ask for your affirmative consent before charging you. You will also receive a confirmation that includes these terms and how to cancel.
  • Your subscription terms. The renewal terms disclosed at checkout and in your confirmation are part of your agreement for that subscription.
  • Cancel online at any time. You can cancel online at any time through your account settings or the cancellation link in your confirmation email. You can also email us at welcome@thevitalitycollective.co with the subject line “Cancel Subscription.” If you subscribed through the patient storefront, you can cancel online through your storefront account, or contact us and we will help.
  • What canceling does. Canceling stops future renewal charges. The terms disclosed at checkout explain when your cancellation takes effect.
  • Reminders and changes. We will send renewal reminders and notices of material changes to your subscription, including price increases, as required by law. We will give you notice before a price change takes effect, so you have a chance to cancel first.
  • Medication plans. Recurring medication shipments continue only as long as your clinician determines the medication remains clinically appropriate. Your clinician may require follow-up check-ins or lab work and may pause or end a prescription at any time.

11. Digital Products

We offer digital products, such as the Hormone Reset Blueprint (a downloadable PDF), and may offer other guides, courses, templates, and resources. We also offer free resources, such as self-check results and free guides.

  • Delivery. Digital products are delivered by download link, email, or online access after purchase. If you do not receive your product, please contact us at welcome@thevitalitycollective.co.
  • Your license. When you buy or receive a digital product or free resource, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, view, and print a copy for your own personal, non-commercial use.
  • What you may not do. You may not share, resell, sublicense, redistribute, publicly post, or upload a digital product (for example, to a file-sharing site, social media group, or course platform); modify it or remove any copyright or other notices; use it with clients or for any commercial purpose; or use it to develop or train artificial intelligence or machine learning tools, unless we give you written permission.
  • Educational only. Digital products are educational resources and are subject to Section 3. They are not medical advice, and they are not a substitute for care from a licensed clinician.
  • End of license. Your license ends automatically if you violate these Terms.

12. Members-Only Community

We may offer a members-only online community with free and paid membership tiers. Paid tiers may renew automatically, as described in Section 10 and the terms shown at checkout.

  • Community terms. Separate community terms or guidelines may apply and will be presented when you join. They apply together with these Terms. If they conflict with these Terms, the community terms control for the community.
  • Peer support and education. The community is a space for education, connection, and peer support. It is not clinical care. Any clinician or team member who participates is sharing general education, not individual medical advice, and no provider-patient relationship is formed through the community. Other members’ posts reflect their own experiences and opinions and have not been verified by us.
  • What you share is visible to others. Information you post in the community may be seen by other members. Please think carefully before sharing health details or other sensitive information. We cannot control what other members do with information you choose to post. The community may be hosted on a third-party platform with its own terms and privacy notice.

13. Communications: Email and Text Messages

Electronic communications

You agree that we may provide notices, disclosures, agreements, and other communications to you electronically, including by email or by posting them on the Site, and that these electronic communications satisfy any legal requirement that they be in writing.

Email

We send transactional and service emails, such as order confirmations, digital product delivery, booking reminders, account notices, and replies to your questions. We send marketing emails, such as newsletters, educational content, and offers, only if you sign up for them. You can unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any marketing email or by emailing us. You will continue to receive transactional and service emails after you unsubscribe from marketing emails.

Text messages

We send text messages only to people who separately agree to receive them, either by checking an unchecked consent box or by texting a keyword we publish. Informational texts (such as booking reminders) and marketing texts each require their own consent.

  • Consent to receive text messages is not a condition of any purchase or of booking a call.
  • Message frequency varies. Message and data rates may apply.
  • Reply STOP to any message to cancel at any time. Reply HELP for help, or email us at welcome@thevitalitycollective.co.
  • Mobile carriers are not liable for delayed or undelivered messages.
  • Please tell us if you change or give up your mobile number.

For more about how we handle text messaging, see Section 8 of our Privacy Policy.

We aim to keep detailed health information out of emails and text messages. Standard email and text messages are not fully secure, so please do not send detailed medical information through them.

14. Testimonials, Reviews, and Individual Results

  • Individual results vary. Testimonials and reviews on our Site and social media reflect the real experiences and opinions of the individuals who gave them. They are not a promise or prediction that you will have the same or similar results. Results depend on many factors, including your health history, your clinician’s recommendations, how consistently you follow your plan, and your lifestyle. You should not expect to experience the same results.
  • Honest testimonials. We publish only testimonials and reviews that reflect honest experiences. We do not write fake reviews, and we do not edit testimonials in ways that change their meaning.
  • Material connections. If someone giving a testimonial or promoting us has a connection with us that you might not expect, such as being paid, receiving free or discounted products or services, earning commissions as an affiliate, or being an employee or family member, we will clearly disclose it. We require our affiliates to clearly disclose their relationship with us whenever they promote us.
  • Your honest reviews. Nothing in these Terms prohibits or restricts you from posting an honest review of us or our Services.
  • Your testimonial. If you share a testimonial with us, we will ask for your permission before publishing it with your name, image, or other identifying information. We will not publish health information that identifies you without your written authorization.

15. Intellectual Property

The Services and all of their content, including text, graphics, photos, videos, audio, logos, digital products, course materials, software, and the design and arrangement of the Site (together, our “Content”), are owned by The Vitality Collective or our licensors and are protected by copyright, trademark, and other laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and our Content for your personal, non-commercial use. All rights not expressly granted to you are reserved.

“The Vitality Collective,” our logos, and related names, designs, and slogans are trademarks of The Vitality Collective LLC. You may not use them without our prior written permission.

If you send us ideas, suggestions, or other feedback, we may use them without any obligation to you.

Copyright complaints

If you believe material on the Services infringes your copyright, please send a notice to welcome@thevitalitycollective.co with the subject line “Copyright Notice,” or by mail to the address in Section 26. Please include:

  • A description of the copyrighted work you believe is infringed;
  • A description of where the material appears on the Services, with enough detail for us to find it;
  • Your name, mailing address, telephone number, and email address;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf; and
  • Your physical or electronic signature.

We may remove material that we believe infringes someone else’s rights and may end the accounts of repeat infringers.

16. Your Content and Community Conduct

“User Content” means posts, comments, messages, reviews, photos, and other material you submit to the community or other public or shared areas of the Services. User Content does not include information you provide in a medical intake or to a clinician, which is handled under the NPP, or personal information you submit through our forms, which is handled under our Privacy Policy.

  • You own your User Content. You keep ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content as needed to operate, provide, and improve the Services, for example, to show your post to other community members. This license ends when you delete your User Content, except for copies that others have already shared, copies in routine backups, and copies we must keep by law. We will not use your User Content in advertising with your name or likeness without your permission.
  • Your responsibility. You are responsible for your User Content. You confirm that you have the rights needed to post it and that it does not violate the law or anyone else’s rights.

When you participate in the community or other shared areas, please:

  • Be respectful. No harassment, bullying, threats, hate speech, or discrimination;
  • Protect privacy. Do not share another person’s health information or personal information without their permission, and do not share other members’ posts outside the community;
  • Share experiences, not prescriptions. Do not present yourself as giving professional medical advice, and do not tell others to start, stop, or change a medication or treatment;
  • Keep it non-commercial. Do not promote, sell, or help others obtain medications, peptides, or other products, including products sold as “research chemicals,” and do not post spam, ads, or affiliate links;
  • Be truthful. Do not post false or misleading health claims, and do not impersonate anyone; and
  • Follow the law and these Terms. Do not post unlawful, infringing, obscene, or harmful content.

We may, but are not required to, review, remove, or restrict User Content, and suspend or remove members, that violate these Terms or community guidelines. We do not endorse User Content, and it does not reflect our views. To report content, email us at welcome@thevitalitycollective.co.

17. Prohibited Uses

You agree not to:

  • Use the Services in violation of any law or regulation, including laws on prescription medications;
  • Obtain or try to obtain medications for anyone other than yourself, or resell, share, or distribute any medication or product obtained through the Services;
  • Provide false, inaccurate, or misleading information, including about your identity, age, location, or health;
  • Impersonate any person or misrepresent your affiliation with any person or organization;
  • Access or try to access another person’s account or information without permission;
  • Scrape, crawl, or data-mine the Services, use bots or other automated tools to access them, copy our Content in bulk, or use our Content to develop or train artificial intelligence or machine learning tools, without our written permission;
  • Interfere with or disrupt the Services, introduce malware, probe for or exploit vulnerabilities, or bypass any security measure, access control, or paywall;
  • Reverse engineer any part of the Services, except as the law expressly permits;
  • Copy, sell, license, or commercially exploit the Services or our Content without our written permission;
  • Use the Services to send spam or other unsolicited communications; or
  • Use the Services in any way that could harm us, our clinicians, our partners, or other users.

18. Third-Party Services and Links

The Services rely on and link to third parties that we do not control, such as the patient storefront platform, licensed pharmacies, laboratories, payment processors, scheduling tools, community platforms, and social media platforms. Independent clinicians also provide care through the Services, as described in Section 4.

Each third party is responsible for its own products and services, and its own terms and privacy notices apply when you use them. Links to third-party websites are provided for your convenience. We do not endorse, and are not responsible for, the content or practices of third-party websites.

19. Disclaimer of Warranties

Please read this section carefully.

To the fullest extent permitted by law, the Site, our Content, and our digital products are provided “as is” and “as available,” without warranties of any kind. We disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not guarantee that the Site will be uninterrupted, secure, or error-free; that our Content is complete, current, or suited to your individual situation; or that you will achieve any particular health, wellness, fitness, weight, or other result from using the Services.

This section applies to the Site, our Content, and our digital products. It does not disclaim any obligation that applies to medications, which are dispensed by licensed pharmacies, or to clinical care, which is provided by independent licensed clinicians, and it does not affect any rights you have that cannot be waived under applicable law. Some states do not allow the disclaimer of implied warranties, so some of this section may not apply to you.

20. Limitation of Liability

Please read this section carefully. It applies to claims arising out of or related to the Site, our Content, our digital products, or your use of them.

To the fullest extent permitted by law, The Vitality Collective and its members, managers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, or loss of goodwill, arising out of or related to the Site, our Content, or our digital products, even if we have been told such damages are possible.

To the fullest extent permitted by law, our total liability for all claims arising out of or related to the Site, our Content, or our digital products will not exceed the greater of (a) the amount you paid us for the specific digital product or Site service that gave rise to the claim during the 12 months before the claim arose, or (b) one hundred U.S. dollars ($100).

This section does not limit:

  • Our liability for gross negligence, willful misconduct, or fraud;
  • Our liability for death or personal injury caused by our negligence, where the law does not allow it to be limited;
  • Any other liability that cannot be limited or excluded under applicable law, including your rights under consumer protection laws that cannot be waived; or
  • The professional responsibility of any clinician, or the responsibility of any pharmacy or laboratory, for the care, medications, or testing they provide. These Terms do not limit or waive any claim you may have against a clinician, pharmacy, or laboratory.

Some states do not allow certain limitations of liability. In those states, our liability is limited only to the fullest extent the law allows.

21. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Vitality Collective and its members, managers, employees, contractors, and agents from any third-party claim, and from related losses, liabilities, damages, and reasonable attorneys’ fees and costs, arising from (a) your User Content, (b) your violation of these Terms, or (c) your violation of any law or of someone else’s rights. This does not apply to the extent a claim results from our own negligence or misconduct. We will notify you promptly of any claim covered by this section, and we may participate in the defense with counsel of our choosing at our own expense.

22. Governing Law, Disputes, and Courts

  • Let’s talk first. If you have a concern or dispute, please contact us first at welcome@thevitalitycollective.co with the subject line “Dispute,” and describe the issue and what you are asking for. We will do the same if we have a dispute with you. We each agree to try in good faith to resolve the dispute informally for at least 30 days before starting a lawsuit. This step does not apply to small claims cases or to requests for urgent court orders, such as to stop infringement of intellectual property.
  • Governing law. These Terms are governed by the laws of the State of Connecticut and applicable federal law, without regard to conflict-of-laws rules.
  • Courts. Any lawsuit arising out of or related to these Terms or the Services must be brought in the state or federal courts located in Connecticut, and you and we consent to the personal jurisdiction of those courts. Either of us may instead bring an individual claim in small claims court in the county where you live or in Connecticut, if the claim qualifies.
  • Your local rights. If you are a consumer and the law of the state where you live gives you the right to have a dispute decided under that state’s law or in that state’s courts, nothing in this section takes away that right.

23. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and change the effective date at the top. If we make material changes, we will notify you before they take effect by posting a prominent notice on the Site or by email. Your continued use of the Services after the updated Terms take effect means you accept them.

Changes will not apply retroactively. A dispute that arose before a change will be governed by the version of these Terms in effect when the dispute arose. Changes to the price or renewal terms of an existing subscription are handled as described in Section 10.

24. Suspension and Termination

You may stop using the Services at any time. To close an account, email us at welcome@thevitalitycollective.co. To cancel a subscription, follow the steps in Section 10.

We may suspend or end your access to all or part of the Services if you violate these Terms, if the law requires it, if needed to protect the safety or security of the Services or others, or if we discontinue a Service. Where reasonable, we will give you notice. Ending your access to the Site does not, by itself, end any clinical relationship. Clinicians manage continuity of care and maintain medical records under their own professional and legal obligations.

Sections that by their nature should continue after these Terms end will continue, including the sections on intellectual property, User Content, disclaimer of warranties, limitation of liability, indemnification, governing law and disputes, and general terms.

25. General Terms

  • Entire agreement. These Terms, together with any additional terms that apply to a specific Service (see Section 1), are the entire agreement between you and us about the Services.
  • Severability. If any part of these Terms is found unenforceable, that part will be limited or removed only as much as necessary, and the rest of these Terms will remain in effect.
  • No waiver. If we do not enforce any part of these Terms, that is not a waiver of our right to enforce it later.
  • Assignment. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours in connection with a merger, acquisition, reorganization, or sale of all or part of our business, or by operation of law.
  • Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, outages, labor disputes, supply shortages, or government action.
  • Relationship. These Terms do not create any partnership, joint venture, employment, or agency relationship between you and us.
  • Notices. We may send notices to the email address you provided. You may send notices to us at the email or mailing address in Section 26.
  • Interpretation. Section headings are for convenience only. “Including” means “including, without limitation.”
